1. Acceptance of Terms

By accessing or using Presskid ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms on behalf of yourself and, if applicable, your company.

2. Description of Service

Presskid is an AI-assisted public relations platform that helps businesses and PR professionals:

  1. discover and identify relevant journalists and media contacts,
  2. analyse coverage and topics based on publicly available professional information,
  3. generate personalised pitch emails and related messaging suggestions, and
  4. optionally send outreach emails from within Presskid via a connected Google account (Google OAuth / Gmail API), using the user's own email identity.

Presskid does not provide legal advice and does not guarantee media coverage, publication outcomes, or response rates.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration,
  • Maintain the security of your password and account credentials,
  • Promptly update your account information if it changes,
  • Accept responsibility for all activities that occur under your account, and
  • Notify us immediately of any unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or use the Service for illegal purposes.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Send spam, unsolicited bulk emails, or harassing communications,
  • Violate any applicable laws, regulations, or third-party rights,
  • Scrape, harvest, or collect data from the Service without authorization,
  • Impersonate any person or entity or misrepresent your affiliation,
  • Upload viruses, malware, or other harmful code,
  • Interfere with or disrupt the Service or servers,
  • Attempt to gain unauthorized access to any part of the Service,
  • Use the Service for any illegal or unauthorized purpose.

Outreach and compliance

If you use Presskid to contact journalists or any other recipients (including via Google OAuth/Gmail), you are solely responsible for:

  • ensuring that you have all required rights and lawful basis to process recipient data and to contact recipients,
  • complying with all applicable marketing/anti-spam and communications laws and regulations,
  • the content of messages you send, and
  • maintaining and honouring opt-outs, do-not-contact requests, and other recipient preferences.

We may implement technical and organisational measures to prevent abuse (including rate limits, blocking, suspension, or termination) and may remove or restrict access to features if we suspect misuse.

Violation of this policy may result in immediate termination of your account and may expose you to legal liability.

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate content including, but not limited to, pitch emails, journalist matches, and media analysis. You acknowledge that:

  • AI-generated output is provided for informational purposes and as a starting point,
  • You are responsible for reviewing, editing, and verifying all AI-generated output before use,
  • AI-generated output may contain errors, inaccuracies, or inappropriate suggestions,
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated output.

You should not rely solely on AI-generated output for important decisions. We are not liable for consequences arising from your use of AI-generated output.

6. Intellectual Property

Presskid is a product operated by ampyre GmbH ("ampyre"). The Service and its original content, features, and functionality are owned by ampyre and/or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you create or upload to the Service ("User Content"). By using the Service, you grant ampyre a limited, non-exclusive, worldwide license to host, process, transmit, and display User Content solely to provide and improve the Service, including generating pitches and enabling sending workflows at your request.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written permission.

7. Subscriptions and Billing

Certain features of the Service require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described at the time of purchase,
  • Provide accurate billing information,
  • Authorize recurring charges for subscription renewals.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds, if any, are provided in accordance with our refund policy.

We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

8. Google Integration (OAuth / Gmail)

If you choose to connect a Google account, Presskid will access Google services via OAuth to provide user-requested features such as sending outreach emails from within the Service and supporting related workflows.

You acknowledge and agree that:

  • You authorize Presskid to access your Google account via the permissions ("scopes") shown on the Google consent screen during connection,
  • You are responsible for the messages you send, the recipients you contact, and compliance with applicable law,
  • You can revoke Presskid's access at any time by disconnecting Google within the Service and/or through your Google account security settings.

Presskid processes message content transiently to compose emails in the UI and to transmit messages for sending at your request. Presskid does not store email bodies as part of this sending flow, unless you explicitly save content into the Service (e.g., as notes in your workspace).

9. Data and Privacy

Our collection, use, and protection of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

The Privacy Policy explains what data we process, for which purposes, and the rights available to you and, where applicable, to journalists included in our media database.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMPYRE, PRESSKID, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11. Indemnification

You agree to indemnify, defend, and hold harmless ampyre, Presskid, and their affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  1. your use of the Service,
  2. messages you send (including via connected email accounts),
  3. your violation of these Terms,
  4. your violation of any law or regulation (including marketing/anti-spam and data protection laws), or
  5. your infringement of any third-party rights.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, limitations of liability, and indemnification.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date.

If changes are material, we may require you to accept the updated Terms before continuing to use the Service. Continued use after changes become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Germany.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
